It just seems silly to me. BUT... on the other hand, working in publishing, I've seen first-hand how overboard lawyers can go (no offense to any lawyers who "play" here). After all, they make tons of money on cases a lot more frivilous than some Raspberries fan filing a suit because a limited edition wasn't limited enough. But I would say it is possible.... It's a way for a lawyer to create "work" --- and more income. Would he have leg to stand on? I just don't see it....Gosh, this is so silly.... PS: If it turns out that a potential "victim" could indeed file a legit lawsuit, then the answer is pretty simple, as Paulie pointed out: Avoid some goon's potential legal action by dropping the Raspberries pin from the next run and dropping the price to $124.99. And don't call it "limited edition." People can be real *&*holes, after all (no offense to anyone here).Gosh, this is silly....(Can I get sued for saying any of that? Slander, maybe?) I'm all for getting as much Raspberries product into the public domain at commercial rates as possible. They deserve it for all that's gone before and for just being up to continuing with the good work. The fans deserve a chance to get the full product too and I feel gutted for those who are facing the prospect of missing out on seeing the full concert.I'm utterly thrilled to have secured one of the 300. But I would have paid the same or maybe more just to get the DVD of the full concert. I was only expecting the CD or CD/DVD options and I had set my heart on the DVD as there aren't too many Raspberries concerts to go to here. The fact all the other bells and whistles were included is fantastic and is what makes these guys so special that they would do that.I didn't go for the "Ultimate Fan Pack" version of the "Tonight" book as I honestly felt there were people more deserving of that moniker than me. But if that had been the only way to get the book, then who knows............? Would those that did go for the Full Monty have been miffed if that run had been extended after they had handed over their hard earned?Personally I think they under pitched the number of special edition sets at only 300 but I appreciate how difficult it is to get the anticipated demand versus cost equation right. For any knucklehead that is considering a lawsuit, could you convince a judge that you wouldn't have purchased the CD/DVD had you known there were going to be 1,000 released instead of 300. Plus, you'll have to show damages. "Geez, your honor, I could have gotten $175 on ebay..."Print as many as you can sell. It's not $125 because it's a limited edition. While I am a lawyer in Canada and would never profess to be an expert in American law (or even provide advice on it - I'm just playing devil's advocate here), breach of contract is simply not delivering what was contracted for. There is a contract between the Raspberries and every one of the 300 people who ordered the limited edition. If one of those 300 people can establish that they did not get what they contracted for (e.g. 1 of only 300 copies of the limited edition), it starts to look like breach of contract. You'd have to look at the wording of the "offer" to do a proper analysis of this issue. Believe it or not, there are a whole lot of other legal issues here. (Being a lawyer is kind of like paying "spot the issue" for a living.) For example - what law governs the contracts? Is it Ohio law? How about for somebody like me who lives outside of the U.S.? This wouldn't be difficult to research, but it is another example of the minefield that routine business can often become.And who exactly has contracted with the purchasers? What exactly constitutes "Raspberries", legally speaking? There have been some alternative suggestions made here...and each one has to evaluated on its own merits. Would taking away a pin be enough? It all takes time and money to research. Maybe there would have to be something of value taken away from the package to sufficiently distinguish it from the original "limited edition". But of course you need a lawyer with expertise in the area of law (and the appropriate jurisdiction) to tell you that.Anyway, all this is a long-winded lawyer's hypothesis as to why extending the limited edition is not a simple decision to make. Hell, you can sue anyone for anything under the sun in this country - and probably in Canada as well. It does, however, become a practical question regarding who, among the purchasers of the original 300 sets, would feel they've been wronged by the band because they're trying to make a few more dollars by expanding the number of sets released.Hell, I'll defend the right of anyone here to sell their limited edition set on Ebay if they so choose...but I'd be tempted to go medieval on anyone who would sue the band over denigrating the "limitedness" (if that's a word) of their set by releasing more copies! There is an indicia that says this is a second or third or forth printing...How hard is it to stick a label on volume 301 - 1000 saying that they are the "second edition?"How hard is it to just NOT NUMBER THEM! When you are offering a limited number of signed items, you can still offer the same identical package in an unsigned version.But wait... order by (insert date here) and you can recieve an officially signed (insert item here)... and that creates another set... no legal issues from the first group (or the 290 +/- who have not waived their rights yet... )Besides, isn't Eric's brother a lawyer? If we get enough money, we could quit work, buy a fleet of VW mini-buses and follow Ernie's Ryder truck from town to town. After the news reports and coverage by Olberman and O'Riley, people all across the USA would know about the tour and then the band could pack some big venues. And then there'd be enough money for a bunch of studio time and a new studio CD. I bet we'd have enough left to even pay Cat Stevens to help Eric on a new Christmas CD! austinberries Posted January 10, 2007 Share Posted January 10, 2007 this is a long thread, but i'll just chime in for being on the record, as honest feedback helps in any situation:price: too high by a substantial amount, tho' i bought into it. why? to support, encourage, & thank the band, & to obviously enjoy the material/media (missed the live shows being here in texas)glaring oversight: for the price, a copy of the book TONIGHT should absolutely be included, especially w/ it's tie-in to the harmonic reconvergence of the bandquantity of LE run: if they can manage to reproduce & sell another run of the LE set - more power to them! there are other folks that know what we've known all along, that RASPERRIES are the greatest, & they should be able to take this all in toolawsuit or resentment toward band if they produce another LE run: laughable, but would love to see a couple of lawyers eat each other & get nothing out of it!
